Anthropic’s Claude is rightly gaining attention in the UK legal sector

From a pure capability perspective, it’s one of the strongest models we’ve seen from the main broad capability AI models for document analysis, synthesis, and reasoning-heavy legal work. As well as operational and other firm functions, such as marketing, that require generated content.

To assist our customers’ compliance requirement we looked into data protection, privilege, and regulatory exposure in Claude’s deployment model. This identified potential real compliance challenges that were easy for firms to underestimate and users to be aware off.

Subscription tier matters – avoid person use plans

Consumer and team-level Claude subscriptions (including paid tiers like Pro and Max) do not come with a Data Processing Agreement and retain user data for extended periods (up to five years), with training enabled by default.

From a UK legal perspective, that alone should be a red flag.

Only Enterprise, API-based, or cloud-hosted deployments offer the contractual controls needed to process client data safely.

Data residency is not as straightforward as it appears

By default, Claude data is stored in the US. While the UK–US Data Bridge exists, it does not align cleanly with GDPR Article 9 special category data, particularly where legal matters involve criminal offence data, health data, or other highly sensitive information.

That creates a genuine risk gap for firms handling regulated client work.

The legal and regulatory implications

In practice, we’re seeing three recurring risk areas:

→ GDPR exposure under Articles 28 and 44–49 where non-enterprise accounts are used for client data.

→ Privilege risk, where inputting legally privileged material into consumer AI tools could be argued to constitute third-party disclosure, risking privilege waiver under SRA Code of Conduct Rules 6.3-6.5.

→ False reassurance from “big tech” branding, particularly where Claude is accessed via other platforms that operate entirely on US-based infrastructure.

All of these are governance issues firms can be expected to explain if challenged by clients, insurers, or regulators.

Anthropic’s Claude is also a model available within Microsoft Copilot paid subscription plans. In the UK and EU Microsoft disable this by default. It is worth checking that this hasn’t been enabled through the opt-in function by your organisations global Admin or service provider.

What compliance use actually looks like

For firms that want to use Claude safely, the following options provide more control and options over how your data is stored and processed.

→ Enterprise agreements with zero-data-retention terms.

→ API deployments with explicit DPAs.

→ Cloud-hosted models (e.g. via AWS or Google) with EU/UK region controls.

Anything else should be treated as non-client, non-confidential use only.

Practical next steps for partners, compliance officers and operations management

We focus on Anthropics Claude in this article, but the following steps can be applied to the use of other AI tools within your firm:

1. Auditing where and how Claude is being used across the firm (including “shadow AI”).

2. Mapping subscription tiers against data protection obligations.

3. Updating AI acceptable-use policies so they reflect reality, not assumptions.

4. Running education and AI use awareness sessions to help ensure applicable use of AI.

5. Completing Transfer Risk Assessments where personal data is involved.
